If they did that there would be lawsuits for charging more for the same amount of content just because of what console they play it on

Meh... They'd just put some new term of service agreement up that no one would read and would just say yes to... Then say "you signed the agreement".

True. Hell, they probably did that already. Remember when they updated the ToS after launch and made you reaccept it to play? They may have snuck that in then. Those evil lawyers at activision >_<
