Why don't the ODST's use the magnum. And which pistol is better?

They do. They aren't required to use the weapons we encounter in ODST, it's just the weapons that suited their mission the best. Anyway, the Pistol you see in ODST is the M6C/SOCOM. The same pistol that was in Halo 2.

The fire rate of that pistol would have made it so OP with the scope had they not nerfed its DPS. Dual wielding them in Halo 2 Multiplayer allows you to fire as fast as you can pull the trigger.
