I think that the lady wouldn't be going to jail for assault and probably numerous other charges if she had only filed for divorce, but now she's going to surely go to jail for assault and probably numerous other charges.

You're probably right -_- But in that case, surely the lawyers and judge would find her accusation false, especially because the guy couldn't do [i]that[/i] if he had no [i]thing[/i] left to do it with! Then it would be assault, numerous other charges, and slander/false claims.
