How should this be handled? He's being tried as an adult. He may have "mental issues" but that is yet to be determined. His family does not want him back in the home.

It's in no way fair or just to try a 10 year old as an adult. What's the point of having a distinction between adult and juvenile if you can just move the lines whenever you want?

I don't think I could kill someone unless it was a live or die situation.. And they deserved it. I couldn't live with the guilt. How that 10 year old will manage to live with this for the rest of his life I'll never know.

If he understood that knew he could physically hurt her, the implication is he knew that he could hurt her badly enough to kill her. Therefore a conscious act, and if not premeditated, at least manslaughter

I'd say at 10 he fully understood what he was doing, hurting another human. All because she asked him to leave, imagine what could happen if he felt a more drastic reaction was ended to teach someone a lesson down the road?

If my 10 year old child "murdered" someone. I would still love them and even try to protect them. 10 years old is too young to treat as an adult. Their brains aren't developed they don't understand.
