Can the Halo 3 soundtrack be used in machinima that displays ads on YouTube without having to buy a licence?

No. If you make profit from something using that content, that's breaking the law, then. You would need to get the express written consent of Microsoft to use it.

This is a question for 343i, I think, (Unless marty/bungie still has rights to the music), but I'd guess MS wouldn't mind.
