You might remember this from a while back. Well, the cop had his day in court today. He claims he lunged at her to knock the bottle out of her hand after she refused to drop it, as he thought she threw beer at him even though the video shows someone else flicking something from a bottle.
The judge, who came to the no guilty verdict WITHOUT A JURY, seems to think the video "didn't tell the whole story", with a district attorney also stating, "Let's be clear there were no winners on that day in September. While I believe Jonathan Josey was guilty of simple assault this is not the time to dwell on that and I hope as a community we can move past this."
What bullshit.

Police in the US operate with absolute impunity and reduced sentences ALL THE TIME. There is an endless list of assaults, -blam!-, unlawful searches, muggings and out right murder that they get away with. There is an epidemic of police brutality and the US DOJ complies with it fully.

Hmmn. See, looking at the way that he moved in the attack, I'm tempted to believe the idea that he was trying to knock a bottle out of her hand - it was near her face at the time, and the way he was swinging his arm just wasn't consistent with the act of punching her. But even allowing for the general mania of public order law enforcement, trying to knock the bottle out of her hand just isn't the appropriate way to respond to that. Take it off her, fine - but not in the way that he was trying to. The judge even said that Josey was guilty of simple assault. I'd be inclined to convict, but be very lenient with the punishment. He has already been fired from the police, that should be enough.

Edited by RighteousTyrant: 2/27/2013 2:01:04 PMYou are factually incorrect where you state:
The judge . . . stated ". . . While I believe Jonathan Josey was guilty of simple assault this is not the time to dwell on that and I hope as a community we can move past this."
Per the article you've linked, the DA said that, not the judge.
In a statement released to media outlets, District Attorney Seth Williams said he will respect the judge's decision although he disagrees with it. "While I believe Jonathan Josey was guilty of simple assault this is not the time to dwell on that and I hope as a community we can move past this," Williams wrote.
Verdict is bullshit, IMO. He doesn't seem very shocked when he proceeds to put her in cuffs. Seems like someone shocked about her going down would be much more concerned for her well being in the moments immediately after.

It looks to me like he was trying to knock the bottle out of her hand.

Edited by All of Humanity: 2/27/2013 12:33:51 PMThere are other videos of the incident that show more. If I remember correctly that women was spraying I'm assuming silly string at the officers. Still doesn't justify the cop punching her.

Edited by Spartan Ken 15: 2/27/2013 12:28:43 PMI don't understand how he says "the video doesn't tell the entire story" yet is sure the girl " was guilty assault". Also from what I have seen, more and more judges have been hard on cops but cop have still getting away with this. I would try and go to a higher court.

Throwing water on someone can be considered assault.
