Does Bungie or Microsoft own the rights to Soffish?

If I wanted to use Soffish as a main character in a video game, do I need Bungie's permission? I assume I would. I would also like to use some of bungie.net Soffish assets to throw together a kickstarter project(to acquire development tool licenses). Whom would I need to contact to secure those rights? Is this the proper venue to inquire about such information? Or should send a written letter requesting such information? Or would all this be a waste of time because Bungie wants exclusivity for Soffish?

  • Soffish is/was (I believe) a trademarked novelty item manufactured and sold by some (probably long since defunct) Asian toy maker. I don't think (but this is just a guess on my part) that Bungie has re-trademarked it but treats it as a parody fair-use reference.
