Depends on what you spent it on. If it's for any of the already released expansion and content, they could probably just use the part of the user agreement that says they can change the requirements of the game at any point without notification, or the part that say they can revoke your access for any reason, or any of the other clauses that says they can do whatever they want. If it's for the upcoming stuff, I doubt they would care about the loss of your money, if they're investing no effort to fix the problem. The difference between this and the cutscene FPS stuttering being it's not a quality of life issue, it's a complete denial of access issue. The only real penalty in that situation would be bad publicity. But they probably have more than enough people/players that will just mock you for having a old or crappy system, so that you don't "deserve" to play the game anyways. If you're in a country that has better customer protections, maybe you can get something done, if you make it a legal issue. But I doubt someone who is using the older OS due to "reasons" is going to invest the thousands it will cost to even attempt to take them to court. And yes, it's Bungie's fault that I have so much time to develop all these negative thoughts and theories. That's what I usually play the game to suppress. =P

Players had more leverage against Cyberpunk because all those issues came up at launch. This is a problem that came up 1 to 4 years after the product was launched, depending on if you're counting from Beyond Light or vanilla release, which people then dismiss using any of the previously mentioned reasoning or methods.
