LEGACY CONSOLE Upgrade Process not responding (XBOX) Get Error Code every time!!!

I own both a 360 and ONE. I have since the AUG update went to play on my Xbox One which it then prompted me to merge/upgrade my account. I accepted this and every time I get error Code: Tapir. which I looked it up and it said Bungie doing maintenance. Which is not the case because I have been affected by this error for over 2 weeks and unable to play Destiny on my xbox one because of it. To ensure the servers were not down and that my account was still working, I signed onto my 360 and it works fine. Why will my Xbox 1 not upgrade? I am stuck at the annoying terms/conditions page asking me if I want to merge. I say YES/ACCEPT every time and it begins to sign in only to end on Error Code: Tapir... every singe time. Has anyone else had this problem or currently experiencing it???? I am seriously about to leave Destiny forever and move onto a different game because this is ridiculous!!!
