That would be like being charge someone for theft when the bought a stolen car from a used car dealer. Disseminating copyright material you do not have the rights to IS illegal. Which would be uploading stolen movies or giving them out on the street. Selling them is worse because it basically is stealing since you do not own the rights to that movie, nor helped create it, yet are taking all the profits.
