Isn't using a KB and M against the consoles ToS or something? You know because he has to use third party hardware to accomplish it.

Still needs third party hardware to accomplish that. Also if he is using a mouse won't he just have a keyboard as well, seems a bit strange to have one hand on a controller and the other on a mouse.
