Anyone with common sense should have terms before signing with people.
If I'm a LeBron James and the utah jazz wants to sign me, I'm going to make terms so they can't ass -blam!- me.
Developers should know this since all these companies like EA destroy games.

Well, you also have to think if it as a publishers view. Bungie tried to do something new. When someone tries something new, it's a huge risk. So who knows how many companies rejected Bungie. (Is taking a business class.) So who knows if Activision was Bungie first choice. But that's just my two cents.

Possible, but I feel as if any publisher would want to jump on the destiny cash cow.

And who is best at owning Cash Cows? Activision (EA as well arguably), so if my previous theory is incorrect, then it's about how much Activision payed to publish the game. But we don't have the background info so we will never know.
