While it doesn't specifically cover this exact scenario, it does make it abundantly clear you do not own any digital currency in D2. I skimmed through the other sections and there's also a class action waiver, so everyone would have to submit individualy.

Any person(s) who may have purchased 3rd party items for the explicit purpose of getting bonus XP codes and didn't receive said bonus were defrauded by paying for a product that functioned differently than what was advertised.

Ah, I'm in the United States, that section only pertains to Non North Americans, if you read our equivalent section, it basically says, "You're boned".
