Yep. They could cut off all the servers for all consoles tomorrow, and it would still be legal.

You're right about that, but, this isn't just "shutting everything off for everyone." It's a deliberate exclusion of a particular class of players in their community. About 16% players, if their old numbers are to be considered viable. Some might claim "discrimination." But again, I'm not a lawyer, myself.

[spoiler]Federal and state laws prohibit discrimination in employment, availability of housing, rates of pay, right to promotion, educational opportunity, civil rights, and use of facilities based on race, nationality, creed, color, age, sex or sexual orientation. A console doesn't legally qualify as something to be discriminated on. The game is 2 years old which is far longer than most online games shelf life, console at least.

Wouldn't matter if others claimed discrimination. If they've signed the EULA and ToS (which they have, so they could play it) they gave that ability up.
