Well people getting banned due Bungie's ignorance is terrible. If cheaters were named they could be avoided. People get named when arrested before they even get charged of anything. The harassment theory is hardly a problem compared to innocent people being banned.

Bungie already knows who the cheater is. They see it in the game film and on the report form. You'd report the guy that was cheating, not just some random guy in the party, right? The point is that if you are in a Fireteam with a cheater and you win, you are not innocent. You've gained an unfair advantage by cheating. To quote from the Help article:
...deriving gameplay benefit from another player's behavior [cheating] is a breach of the License Agreement that governs Destiny, and therefore potentially subject to access restrictions.
Edited by zombiehaddock: 6/29/2016 5:42:00 PMI'm not sure if you are being deliberately obtuse or not. The point is until you actually get into the game and start playing how do you know if someone you hooked up with on LFG is a cheater unless their names are put out there somewhere so you know to avoid them? Its no bloody use only Bungie knowing them is it?
...deriving gameplay benefit from another player's behavior [cheating] is a breach of the License Agreement that governs Destiny, and therefore potentially subject to access restrictions.
All this does is confirm the need to have a list of names of who cheats are. I go to LFG, I post LFG trials run. I get invited to a party, we go to trials, we play, one of my team cheats, I get banned. How could I avoid that? Either ask if they cheat (they cheat, they are dishonest so not really putting much faith in that system to be honest) of never use LFG which would be fine if Bungie actually provided a matchmaking system. If someone gets arrested and questioned for a crime it is so anyone with any evidence may come forward to aid the investigation, that is done regardless of harassment worries because there is no greater crime than innocent people being found guilty. You can argue about one being the breaking of the law rather than the rules of a game however, to the innocent person the cost is the same, a loss of liberty to do as one wants.

As I said before, it's not a perfect system. Innocent people are going to get banned in any game. It's very rare that this happens, though, because seriously, how many people are you going to hook up with through LFG who just happen to be cheating? Bungie knows nothing about the player a cheater may be playing with, so they have to assume that that player is completely aware of that fact. I'd rather have a couple of people get a temporary ban than have cheaters running loose because someone at Bungie thought, "hey, this guy is playing with a cheater and is winning because of it, but he might not know he's cheating, so I'll let it slide." I do see your point, there should be a clearer way to determine who is really at fault. Unfortunately, there really isn't. All Bungie gets is a game tape and a report form to go off of. They have to operate under the assumption that all parties that may be guilty are guilty. Otherwise, a lot of cheaters would get away with it. I don't make the ban policy. I agree with it for the most part, but if you don't like it, that's tough. It's the system we have, and we have to deal with it. That's how it goes.
